Wisconsin Attorney General's
Opinion
re: Open Carry and Disorderly Conduct
The attorney General's memo on the interplay between open
carry of firearms and the Wisconsin disorderly conduct statute has only a
very limited, restricted impact on your firearms rights and right to carry
openly. Things to keep in mind when reading and contemplating taking actions
based on this memo:
- It is NOT a formal legal opinion which would have the
force of law. It is much more limited and less authoritative. It is guidance
and education for those in the police and prosecutorial communities who wish
it, but little more.
- You would still be subject to the Gun Free School
Zone restrictions.
- You would still be prohibited from having an uncased
and/or loaded firearm in a vehicle where it is accessible to the occupants.
- You would still be prohibited from placing an uncased
on or in a vehicle.
